Our ability to achieve mutually beneficial results saves our clients time and money. Land Use and Zoning

Our attorneys have a long history of experience and success in handling entitlements for major landmark developments, master-planned communities and mixed-use historic and redevelopment projects, in addition to the day-to-day land use and zoning matters related to the operation and renovation of real estate assets. For decades, developer, land owner, tenant and investor clients have looked to our team’s strategic results-oriented approach to handling land use matters ranging from simple use permits to variance requests, master and general plan adoptions and amendments, and rezoning.

Notably, we represent major commercial, residential, industrial, and master planned developers before zoning and licensing boards in practically every jurisdiction in the state of Arizona, including significant experience working with the Arizona State Land Department.

Our firm has swiftly obtained approvals for high-rise office buildings, master-planned communities, power centers, single tenant retail buildings, timeshare resorts, multi-family residential, industrial parks, hotels, shopping centers, corporate office parks, residential subdivisions, storage facilities, senior facilities, sanitary landfills, and more.

We regularly handle complex business transactions, including drafting complicated transactional documents, purchase and sale agreements, leases, and financing documents as well as deal-specific agreements such as development agreements, easements and covenants, conditions and restrictions (CC&Rs).

Government Affairs and Administrative Law

Withey Morris has had considerable experience in local and state government affairs. We work tirelessly year-round with staff members, government officials, and business and community leaders on important issues that affect local municipalities and Arizona. For an array of clients, we successfully represent the interests of businesses and organizations on important and complex issues ranging from liquor licensing, land use and property rights, transportation, utilities, and request for proposals for city and county contracts.

Liquor Law

Liquor law and licensing is a minefield for clients to navigate. For Withey Morris, however, it’s all in a day’s work. Our attorneys regularly appear before City Councils, the Arizona State Liquor Board, the Arizona Office of Administrative Hearings, and all subsequent appellate courts on behalf of licensees. The breadth of our experience extends from single store businesses and restaurants to some of the largest nationwide licenses, such as CVS/pharmacy. We regularly assist liquor licensees in license acquisition, application preparation, license transfer, and liquor violations and compliance. We’re well versed in every aspect of our practice and liquor law is no exception.

Professional and Business Licensing

Arizona has several boards and agencies governing professionals and businesses, and Withey Morris has experience with most of them, including the Arizona Department of Liquor Licenses and Control.  With each governmental entity having its own statutes and regulations, licensing matters can often seem deeply confusing and complicated to clients. A license complaint can be one of the most stressful experiences for any professional or business. That’s where we step in. If you have received notification of a complaint and need to file a response letter, have an upcoming interview or hearing, or simply need advice regarding an application, we can assist you.
